Terms of Service

These terms govern use of HomSerAI's website and software, provided by HomSerAI LLC. By creating an account or using the service, you agree to these terms. HomSerAI is provided for business use. You must have authority to act for the business associated with your account.
Accounts and business responsibilities
You must be at least 18, provide accurate information, protect your credentials, and manage your employees' permissions. You are responsible for activity through your accounts and for having the rights and permissions to upload and process customer information. Tell us promptly about unauthorized access.
Subscriptions and charges
Your selected plan, billing interval, trial if offered, usage allowances, and additional charges are shown in the app or checkout. Paid subscriptions renew according to the terms shown at purchase unless cancelled. Usage add-ons, communication services, registration charges, taxes, and payment-processing fees may be separate. Free tester access, where granted, does not automatically become a paid subscription. You must explicitly authorize a purchase.
You authorize the payment processor to collect agreed subscription and other authorized charges. We will provide notice of changes to recurring prices before they apply. See our cancellation and refund policy.
Sales tax on HomSerAI purchases
Subscription prices are in USD and exclude applicable sales tax unless expressly stated otherwise. HomSerAI collects and remits sales tax where required by law, based on the location where your business receives or uses the service and our applicable tax collection obligations. Any applicable tax is shown separately at checkout and on your billing invoice. Taxes may also apply to add-ons and optional services according to their classification and the applicable law.
You must provide an accurate business billing address and keep it current. If your business qualifies for a sales tax exemption, contact support@homserai.com and provide valid supporting documentation for review before purchasing. Tax collection may change as tax laws, your location, or our collection obligations change. This policy covers purchases from HomSerAI; taxes on services you sell to your own customers remain your responsibility.
Your content and customer data
You retain ownership of your uploaded business content. You grant us permission to host, process, display, and transmit it as needed to provide the features you use. Our Privacy Policy explains our handling of information. You are responsible for the accuracy of estimates, invoices, taxes, schedules, customer records, and instructions you approve.
Communications and AI
You must obtain required consent for calls, recordings, texts, and marketing, honor opt-outs, and follow applicable laws and provider policies. Do not use the service for unsolicited or prohibited communications. Sending hours and templates are tools; they do not replace your compliance responsibilities.
AI output can contain mistakes. Review drafts, pricing, extracted customer details, and suggested actions. Enabled automations and AI receptionist features act according to your configuration. HomSerAI is not an emergency service and does not guarantee that every inquiry is captured or that every communication is delivered.
Third-party services
Email, calling, messaging, maps, AI, and payment features depend on third-party services and required setup or approvals. Their terms, availability, fees, and restrictions also apply. An available setup option is not a guarantee of provider approval. HomSerAI does not hold customer payment funds; payment processors handle those transactions.
Acceptable use
Do not access another company's information without authorization, bypass security or usage controls, upload unlawful content, infringe others' rights, distribute malware, or overload the service. We may restrict or suspend access to address abuse, security risks, nonpayment, or legal requirements.
Availability, cancellation, and data
We work to maintain the service but do not promise uninterrupted operation, permanent feature availability, or specific business results. Features may change. Keep copies of important records and request an export before closing your account. Subscription cancellation and account deletion are separate requests; see data and account requests.
Limits and disputes
To the extent permitted by law, the service is provided as available without warranties of merchantability, fitness for a particular purpose, or uninterrupted operation. HomSerAI LLC is not liable for indirect or consequential losses, including lost profits or lost business opportunities. Nothing in these terms limits rights or liabilities that applicable law does not allow to be limited.
Contact us first to resolve a concern. Connecticut law governs these terms, except where mandatory law provides otherwise. Changes to these terms will be posted with an effective date, with additional notice when required.
